Welcome to the OOMAME - My Asian Marketplace website, operated by Brainfood Ltd., Company No. 516875655 (hereinafter: "the Company", "the Website", "OOMAME", "we").

The use of the Website, including browsing, viewing content, purchasing products, subscribing to newsletters, contacting us, or any other activity on the Website, is subject to the terms of use detailed below. By using the Website, the user agrees to these terms.

The regulations are written in the masculine form for convenience only, but apply equally to all genders.

The Company reserves the right to update these terms of use from time to time, at its sole discretion and without prior notice. The binding version is the one published on the Website at the time of use or order placement.

It is clarified that this is an operational and logistics warehouse only, with no public reception and no option for self-collection, unless explicitly stated otherwise by the Company.

2. Eligibility for Use and Purchases

Purchases on the Website are permitted for users who meet the following conditions:

• The user is at least 18 years old and has the legal capacity to perform binding actions.
• The user holds a valid payment method accepted on the Website.
• The user has provided complete, correct, and accurate details for placing the order, including full name, address, phone number, and email.
• The use of the Website is for personal and private purposes only, and not for commercial, wholesale, or resale purposes, unless prior written approval has been obtained from the Company.

The Company may, at its discretion, not approve an order or cancel an order in cases of incorrect details provided, suspicion of misuse of the Website, suspicion of fraud, breach of terms of use, product unavailability, payment issues, or any other justifying circumstance.

3. Sale of Alcoholic Beverages

If alcoholic beverages are offered on the Website, their purchase is permitted for individuals aged 18 and over only.

Placing an order that includes an alcoholic beverage constitutes a declaration by the user that they are at least 18 years old and that the details provided are correct and accurate.

The Company or its representatives may require presentation of identification upon delivery of an order including alcohol. In the event that it cannot be verified that the recipient of the order is 18 years of age or older, the Company or the shipping company may refuse to deliver the product, and the Company will act in accordance with the law and its cancellation and refund policy.

Minors cannot purchase alcoholic beverages on the Website, and the Company is not responsible for false information provided by a user.

4. Products, Descriptions, and Stock Availability

The Website offers for sale Asian food products, raw materials, sauces, noodles, rice, snacks, beverages, kitchenware, accessories, and other complementary products.

The Company makes every effort to present accurate and up-to-date information on the Website as much as possible, including product names, images, descriptions, prices, weights, country of origin, kosher information, ingredients, allergens, storage instructions, and nutritional information, to the extent that such information is available and provided by manufacturers, importers, or suppliers.

However, there may be typos, inaccuracies, changes in packaging, label changes, color differences between images and the actual product, or discrepancies arising from information updates by manufacturers, importers, or suppliers.

The images on the Website are for illustration purposes only. In case of a discrepancy between the information on the Website and the information appearing on the actual product packaging, the information on the product packaging shall prevail, subject to the provisions of the law.

Product availability on the Website may vary from time to time. A product displayed on the Website does not guarantee that it is in stock at all times. In the event that an ordered product is unavailable, the Company may contact the customer and offer an alternative product, a refund, a credit, or removal of the product from the order.

5. Kosher, Allergens, and Nutritional Information

Some products on the website may be kosher and some may not be kosher. The company makes every effort to display the clearest possible information on the website regarding kosher status, ingredients, allergens, nutritional values, country of origin, storage instructions, and expiry date, to the extent that this information is available to it and provided by the manufacturer, importer or supplier.

Notwithstanding the above, the information on the product packaging is the binding and most up-to-date information. The customer must check the product label, ingredient list, allergen markings, storage instructions, preparation instructions, and kosher markings before use or consumption.

Customers with allergies, sensitivities, dietary restrictions, or kosher requirements are asked to check the information on the packaging before use. If in doubt, you can contact us directly before placing an order or before using the product, and we will do our best to assist and verify the information with the relevant sources.

The company is not responsible for the use of the product contrary to the manufacturer's instructions, storage instructions, preparation instructions, or the information appearing on the packaging.

6. Prices and Payments

All prices on the Website are displayed in New Israeli Shekels and include VAT as required by law, unless explicitly stated otherwise.

The Company may change product prices, shipping costs, promotions, benefits, coupons, and the product mix on the Website at any time and at its sole discretion.

The binding price for the customer is the price displayed and approved at the time of completing the order and payment, subject to the approval of the transaction by the credit card company or payment provider.

In the event of an exceptional and clear error in the price, product description, shipping cost, or any other material detail, the Company may cancel the order or contact the customer to re-approve the order under the corrected terms.

Payment on the Website is made through PayPlus and other secure payment providers as they may be operated on the Website. Credit card details are not stored on the Website's servers but are processed by external secure clearing providers.

The Website may allow payment by credit card, Apple Pay, Google Pay, Bit, and other payment methods as they appear at checkout at the time of purchase. At this stage, the Website does not support payment via PayPal.

The Website may allow installment payments of up to 3 payments, subject to the order amount, the Company's policy, and the payment provider's approval.

Invoices and receipts are generated through PayPlus or its representatives and sent to the customer according to the details provided at the time of placing the order.

7. Shipping and Delivery

The Company provides deliveries according to the shipping options available on the Website, as presented to the customer when placing the order and subject to the destination address, coverage areas, operating hours, availability of shipping companies, and the type of products in the order.

At this stage, the active shipping option on the website is express delivery at a cost of 35 ₪, in supported areas only. Orders placed until 10:30 AM on business days may be delivered on the same day, subject to coverage areas, shipping company availability, operational loads, and circumstances beyond the Company's control.

Orders over ₪399 are eligible for free express delivery in our service areas, subject to the shipping policy published on the website and the conditions displayed at checkout when placing the order.

Additional shipping options, including standard shipping, may be added in the future, in accordance with the Company's policy and the options appearing on the Website at the time of order.

Delivery times and shipping costs may vary depending on the shipping area, available shipping method, time of order placement, and additional operational conditions.

OOMAME endeavors to deliver orders quickly and accurately, but delivery times are estimated and do not constitute an absolute commitment, unless explicitly stated otherwise. Delays may occur due to shipping congestion, force majeure, weather conditions, security events, incorrect address, customer unavailability, shipping company malfunctions, or circumstances beyond the Company's control.

The customer must ensure that the shipping details provided are correct, complete, and accurate. The Company will not be responsible for any delay, non-delivery, or additional cost incurred due to incorrect or incomplete information provided by the customer.

In the event that the shipment is not delivered due to customer unavailability, provision of an incorrect address, refusal to accept the shipment, or any reason beyond the Company's control, the Company may charge an additional shipping fee for re-delivery, subject to its discretion and the provisions of the law.

8. Cancellations, Returns, and Exchanges

The Website's cancellation and return policy is subject to the provisions of the Consumer Protection Law, 5741-1981, Consumer Protection Regulations, and all relevant laws.

A transaction may be canceled according to the conditions and deadlines stipulated by law and the return and cancellation policy published on the Website.

In the event of a transaction cancellation, product return, or exchange request, the customer must contact the Company's customer service and provide the order details, reason for the inquiry, and relevant documentation as required.

Non-food products, such as kitchenware and accessories, may be returned as permitted by law, provided they are sealed, complete, in their original packaging, unused, and their resaleability has not been impaired.

For food products, perishable products, opened products, products with damaged packaging, products with special storage conditions, beverages, or products that cannot be returned for health, hygiene, or food safety reasons - there may be restrictions on return or cancellation, subject to the provisions of the law.

In the event of a transaction cancellation not due to a defect, non-conformity, or breach by the Company, the Company may charge cancellation fees according to the law, if permitted.

In case of cancellation due to remorse or a reason not stemming from a defect or non-conformity, the cost of return shipping shall be borne by the customer, unless otherwise determined by law or at the discretion of the Company.

In the event of a defective product, incorrect product, or discrepancy between the order and the product supplied, the Company will investigate the inquiry and offer an appropriate solution according to the circumstances and the provisions of the law, including replacement, credit, or refund.

A refund, if approved, will be processed within 7 business days from the date of approval of the cancellation or return by the Company, and subject to the processing times of the credit card company or payment provider.
